Below, Vuskoo explains the general terms and conditions of use that apply when you access the website and/or use the services offered on it. These general terms and conditions of use (the “Terms of Use”) govern the rights and obligations arising from access to, browsing of and use of the domain https://vuskoo.com (the “Website”) by users.
1. Controller

2. Access, browsing and security
Accessing, browsing, registering on and using the Website implies expressly accepting and being aware of the legal notices, conditions and terms of use contained on the Website in the version published at the time of access, without reservation. We refer to both registered and unregistered users jointly as the “Users”.
The User declares and acknowledges: (i) having fully read and understood these Terms of Use, the Cookie Policy and the Privacy Policy; (ii) being a person with sufficient capacity to contract, being solely responsible for the truthfulness and accuracy of the data provided; and (iii) assuming all the obligations set out here. If you do not agree with these Terms of Use, you may refrain from using the Website and/or the services offered.
We make every effort to ensure the best possible browsing conditions and to avoid faults. However, we do not warrant that access will be uninterrupted or error-free, nor that the content is error-free or will not cause harm. The Company reserves the right to monitor access to and/or use of the Website and to suspend, remove, limit or prevent access, without prior notice, when anomalies or technical difficulties arise, for maintenance reasons or when these Terms of Use are not respected.
3. Services
Vuskoo's purpose is to provide a Website that works as a comparator of rates or prices for services and products of third-party companies in various sectors, mainly “Internet and Telephony”, “Electricity, water and gas” or “Energy”, among others, and to enable subsequent contracting where applicable, acting as a service company under Spanish Law 34/2002 of 11 July, on information society services and electronic commerce (the “Services”).
Vuskoo may act as an intermediary in formalising contracts with the companies whose services and products it offers. However, the supply contracts will be binding exclusively with their owners, i.e. the third-party companies that offer the products or services. Vuskoo will offer Users the available rates, offers and prices (the “Offer”), which will include VAT, fees and any other applicable charges or taxes; any amount not included will be detailed in the Offer.
Vuskoo does not take part in the final provision of the contracted service or product, acting merely as a comparator and intermediary. To process an Offer, it makes various means available to Users: (i) redirection to the provider's page to contract directly; (ii) providing the provider's contact numbers to contract by phone; or (iii) providing your phone number to be contacted free of charge by the provider or by Vuskoo. Offers are provided directly by the third-party companies and may be modified at any time, so we recommend checking the final conditions before contracting. Vuskoo assumes no liability for the availability, truthfulness, scope or accuracy of such Offers.
Once an Offer has been contracted, within fourteen (14) calendar days from the contracting date, the User may exercise their right of withdrawal over the contracted service or product, without having to justify the reason and without penalty, by contacting Vuskoo or the third-party provider through any of the channels provided.
The Services are offered to persons over 18 years of age resident or domiciled in Spain. Minors may not use the Services without prior authorisation from their parents, guardians or legal representatives. Vuskoo's Services are offered free of charge, as the Company obtains its profits from the commissions of the companies whose products and/or services it compares or intermediates. Vuskoo reserves the right to modify, without prior notice, the design, presentation and/or configuration of the Website, as well as to add or modify Services.
4. User registration process
Access to the Website does not require prior registration. However, to view certain content, contract an Offer or receive newsletters, registration will be required. By registering or requesting a Service, the User accepts all of the Website's legal texts. All required data is marked with an asterisk (*) and must be completed; failure to do so will release Vuskoo from any obligation linked to that information.
All information provided must be accurate, truthful and up to date. The User warrants the ownership, authenticity and currency of the data they provide, being solely responsible for false or inaccurate statements and for any damage caused to Vuskoo or third parties. The forms are provided in Spanish and must be completed in Spanish, unless another language is expressly permitted.
5. User obligations
The User undertakes to make diligent, correct and lawful use of the Website and the Services, in full compliance with the law, good customs and these Terms of Use. The User is responsible for keeping the information provided up to date and is solely responsible for the relationships established with the companies whose services or products are offered.
It is prohibited to: (i) impersonate another person or organisation; (ii) use disrespectful or offensive language, as well as messages containing threats or serious insults; (iii) present, cite or recommend companies or web portals and, in general, carry out unfair competition, marketing or spam actions. Otherwise, the User may incur an offence or crime under the Spanish Criminal Code and Civil Code.
6. Publication of content and links
The Website offers Services and/or content related to Vuskoo's activity and third-party services and products, which are merely informative, without any guarantee of accuracy. The Website may contain links to third-party domains over which Vuskoo has no control or ownership. Vuskoo does not warrant or accept responsibility for the content, commercial activities, products and services that may be linked; the presence of such links is purely informative and does not imply any recommendation or binding nature.
7. Intellectual and Industrial Property Rights
The texts, designs, images, audio, databases, logos, structure, trademarks and other elements of the Website are protected by Vuskoo's and/or third parties' intellectual and industrial property rights. Vuskoo reserves all exploitation rights; access to, browsing of and use of the Website does not imply any waiver, transfer, licence or assignment of such rights.
Any reproduction, transmission, distribution, adaptation, translation, modification or public communication of all or part of the content without prior written authorisation is strictly prohibited. You may establish a link to the Website provided it is not associated with false statements or statements contrary to the law, morality or good customs; altering, changing or modifying the Website is prohibited.
8. Exclusion of Warranties and Liability
Vuskoo strives to avoid errors in the content, but does not warrant or accept responsibility for the consequences arising from errors in its own or third-party content, nor for the truthfulness, completeness, accuracy, lawfulness or reliability of the information, reserving the right to update, modify or remove content at any time without prior notice. The reliability, availability and continuity of the Website are not guaranteed, so its use is carried out at the User's own risk.
The Company assumes no liability, including but not limited to, arising from:
- The use of the content and Offers, prohibited or permitted, in breach of intellectual and/or industrial property rights.
- The content of the pages accessed through links included on the Website.
- The acts or omissions of third parties, even where they are linked to Vuskoo by contract.
- Problems in IT systems or those caused by viruses and other code, as well as security errors, faults or incidents in communications. It is each User's responsibility to have appropriate tools to detect harmful programs.
- Errors or delays in access due to internet network problems, acts of God or force majeure and any unforeseeable contingency beyond Vuskoo's control.
- Errors or damage caused by inefficient and bad-faith use of the Website by the User.
The User warrants that they comply with these Terms of Use, releasing the Company from any liability and undertaking to hold it harmless against any claims, liabilities, penalties, damages, losses or expenses arising from any breach.
9. Data Processing and Cookies
Visiting the Website does not automatically record any personal data identifying a User; certain non-personal information is collected via cookies that provide statistics on the use of the Website. Every User should consult the Cookie Policy. The personal data you provide through the Website, e-mails or phone calls will be processed by the Company on the basis of the consent given for the purposes described in the Privacy Policy, which must be read and accepted.
The User may exercise their rights of access, erasure, rectification, objection, restriction of processing and portability by writing to the Company, either at its registered office or to the data protection officer's e-mail dpd@arkeero.com, proving their identity. If you consider that your data is not processed in accordance with the applicable legislation, you may complain to the Spanish Data Protection Agency.
10. Applicable law and competent jurisdiction
Any dispute arising from access to or use of the Website will be governed by Spanish law and submitted to the exclusive jurisdiction of the Courts and Tribunals of Madrid. However, for any questions relating to the contracting of the products and services distributed by Vuskoo, the courts and tribunals of the consumer's domicile will have jurisdiction. You may also file the relevant complaint via the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.
11. Complaints and claims
We have a customer service team that responds to questions about Vuskoo's own Services and the Offers on the Website. Complaints and claims relating to Vuskoo's own Services must be sent to dpd@arkeero.com. For queries relating to third-party products or services once contracted, Users should contact the respective providers.
12. Changes to the Terms of Use
Vuskoo reserves the right to modify these Terms of Use due to updates, legal changes and needs, as well as improvements and changes in the way the Company offers and provides its Services.
